A. TERMS OF USE ACCEPTANCE

Yale-NUS College, an autonomous college established within NUS (Yale-NUS), maintains various websites (collectively referred to as Yale-NUS websites and individually Yale-NUS website) for the convenience of its staff, students, alumni and/or certain members of the public permitted access to and/or use of a Yale-NUS website, as applicable (collectively referred to as Users and individually a User).

By accessing and/or using a Yale-NUS website, Users shall be deemed to have agreed to be bound by all the terms and conditions set out herein (Terms of Use), which shall govern the use of all Yale-NUS websites wherever applicable. If a User does not agree with any part of the Terms of Use, the User should discontinue access to and/or use of the applicable Yale-NUS website immediately.

Users may also be bound by additional terms and conditions specific to a particular Yale-NUS website, which are set out below and form part of these Terms of Use. In the event of inconsistency between any of the general terms and conditions set out in Section B below and any specific terms and conditions set out in Section C below, the specific terms and conditions shall prevail.

 

B. GENERAL TERMS AND CONDITIONS

Users Conduct

 

  1. Users shall use Yale-NUS websites for lawful purposes only. Where Users are permitted to post or transmit material through a Yale-NUS website, Users shall not post or transmit any material which:
    • is or may reasonably be construed as defamatory, discriminatory, incendiary, threatening, abusive, vulgar, obscene, profane, plagiaristic or otherwise objectionable;
    • violates the rights of others, contains unsubstantiated claims, is invasive of another persons privacy, encourages criminal conduct, gives rise to civil liability or otherwise violates any law or regulations in any jurisdiction;
    • contains viruses, trojan horses, worms, time bombs, cancelbots or any other harmful or disruptive programmes;
    • is protected by intellectual property rights or any other applicable law unless the requisite consents have been obtained; or
    • may cast Yale-NUS in a negative light.

 

  1. Users shall not:
    • use a Yale-NUS website for purposes of impersonating any person or entity;
    • use a Yale-NUS website to transmit any chain letters or junk email to other Users;
    • use the account, username, or password of another User at any time;
    • disclose their passwords to any third party or permit any third party to access their accounts;
    • use any information obtained from a Yale-NUS website to harass, abuse, or harm another person;
    • interfere with or disrupt a Yale-NUS website or servers or networks connected to the Yale-NUS website or disobey any requirements, procedures, policies or regulations of networks connected to the Yale-NUS website;
    • use a Yale-NUS website to undermine the security of, tamper with or access Yale-NUS IT resources, or attempt to do any of the same, for example by cracking passwords or modifying or attempting to modify the files of other Users or software components of Yale-NUS IT resources; or
    • use a Yale-NUS website in any manner inconsistent with any and all applicable laws and regulations.

 

  1. Yale-NUS websites are for the personal use of Users only and may not be used in connection with any commercial endeavours, including the sale and purchase of goods and services as a business. Commercial advertisements, affiliate links, and other forms of solicitation may be removed from a Users profile or webspace without notice and may result in suspension or termination of the Users access and/or use of any Yale-NUS website. Yale-NUS decision on what constitutes commercial use shall be final.

 

  1. Illegal and/or unauthorized use of a Yale-NUS website, including collecting usernames and/or email addresses of Users by electronic or other means is prohibited. Yale-NUS reserves the right to investigate and take appropriate legal action against anyone who, in Yale-NUS sole discretion, violates this provision.

Privacy

  1. The terms of the NUS Privacy Statement found at http://nus.edu.sg/legal-information-notices#pdpa are incorporated into and made part of these Terms of Use and all references to website or site therein shall mean any and all Yale-NUS websites.

Yale-NUS Intellectual Property Rights

  1. Yale-NUS websites incorporate contents and materials belonging to Yale-NUS (Yale-NUS Content), which are protected by copyright, trademark, patent and other intellectual property laws in Singapore and overseas, as applicable. Unless otherwise indicated, Yale-NUS Content may be reproduced and displayed by Users solely for Users personal use in connection with viewing and using a Yale-NUS website and no part of Yale-NUS Content may be reproduced, licensed, sold, published, transmitted, modified, adapted, publicly displayed, broadcasted, stored (including storage in any medium by electronic means, whether or not transiently) for any other purpose without Yale-NUS prior written permission.

 

  1. The copyright in the contents and materials available on Yale-NUS websites are owned by Yale-NUS unless otherwise indicated as owned by third parties.

 

  1. Yale-NUS logos, crests and name are trademarks or registered trademarks of Yale-NUS. Yale-NUS has policies governing the use of its name, including the names of its programmes, and trademarks and use, reproduction, copying or redistribution of the same without Yale-NUS prior written permission is prohibited. Other names and marks appearing on Yale-NUS websites may also be the trademarks of their respective owners and it is the responsibility of Users to seek the permission of the trademark owners prior to using such other trademarks.

 

  1. Yale-NUS name and trademarks should never be removed from pages on which they originally appear and web pages from Yale-NUS websites should always appear exactly as posted without variation, unless Yale-NUS prior written approval was obtained.

Users Intellectual Property Rights

  1. Users shall retain ownership rights in any text, files, images, photos, videos, sounds or any other materials that Users upload or post on any Yale-NUS website (“User Content”). Any such User Content shall not constitute confidential information of the Users and Users authorise Yale-NUS to do anything necessary to such User Content to enable the release of the same for viewing on a Yale-NUS website.

 

  1. The User represents and warrants that: (i) he/she owns the User Content uploaded or posted by him/her on or through any Yale-NUS website or has otherwise obtained the right to upload or post the same, and (ii) the posting of the User Content on or through any Yale-NUS website does not violate the intellectual property or other rights of any person.

 

  1. Users may not copy, modify, translate, publish, broadcast, transmit, distribute, perform, display, or sell any User Content belonging to any other User which appears on or through any Yale-NUS website without that other Users consent.

Removal of User Content and Restriction of Access

  1. Yale-NUS may delete from any Yale-NUS website any User Content that it deems in its sole judgment to have violated these Terms of Use and reserves the right to restrict, suspend or terminate at its discretion any Users access to part or all of the Yale-NUS websites at any time, without notice or reason given and without liability.

Links from Other Websites to Yale-NUS websites

  1. Yale-NUS reserves the right to require the removal of any links from external websites to a Yale-NUS website. Deep linking to the web pages of any Yale-NUS website is prohibited. Any links created by a User to a Yale-NUS website should be text links containing our domain name and which transfer other visitors directly to the applicable Yale-NUS website. The contents of a Yale-NUS website should not appear within the frames of others, nor be accompanied in any way by third-party material that may create a false or mistaken impression in the mind of the viewer about Yale-NUS affiliation or association with or endorsement of the third party site, frame, or material.

Links to Third Party Websites

  1. Users web pages on a Yale-NUS website may contain links to third party websites. Yale-NUS does not monitor and shall not be responsible for the contents, materials, opinions expressed on such third party websites or their accuracy thereof. Inclusion of any link to such third party websites on a Yale-NUS website does not imply approval or endorsement of the linked third party websites by Yale-NUS and Users access such linked third-party websites at their own risk.

Disclaimers

  1. All Yale-NUS Content are provided as is. Yale-NUS has used all reasonable endeavours to ensure that Yale-NUS Content posted on Yale-NUS websites are correct at the time of posting. However, Yale-NUS gives no warranty and accepts no responsibility or liability for the accuracy or the completeness of the Yale-NUS Content for any purpose whatsoever. No reliance should be made by any User on the Yale-NUS Content so posted and the User should independently verify the accuracy and completeness of the Yale-NUS Content with the originating or authorising faculty, department or other body.

 

  1. Users are solely responsible for the User Content that they upload or post on or through a Yale-NUS website and Yale-NUS does not endorse nor have control over the same. Yale-NUS does not warrant or guarantee the accuracy, validity, adequacy or completeness of any User Content and will not be responsible for any errors, inaccuracies or omissions in any User Content posted or liable for any loss or damage of any kind incurred as a result of the use of or reliance on any User Content uploaded or posted on or through a Yale-NUS website.

 

  1. Yale-NUS assumes no responsibility for monitoring User Content and conduct on any Yale-NUS website and shall not be taken to have assumed any responsibility for any User Content or conduct on any Yale-NUS website or for removing or regulating the same, should it choose randomly and at its discretion to monitor a Yale-NUS website.

 

  1. Yale-NUS shall not be responsible for any problems with or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of any email or players due to technical problems or traffic congestion on the Internet or for any damage to the Users computer equipment related to or resulting from access to or use of any Yale-NUS website.

 

  1. Yale-NUS shall not be held responsible or liable in any way for any and/or all consequences, including without limitation damages for loss of profits, business interruption, or loss of information, that may be incurred by a User as a direct or indirect result of access to a Yale-NUS website or of using, or the inability to use, any materials or contents on a Yale-NUS website, even if Yale-NUS has been advised of the possibility of such damages in advance. To the extent permissible by law, no right of action by a User will arise as a result of personal injury or property damage, howsoever arising, sustained as a result of access to a Yale-NUS website or of reference to or reliance upon any information contained in or omitted from a Yale-NUS website, whether through neglect or otherwise.

Indemnity

  1. The User shall indemnify and hold Yale-NUS harmless from any loss, liability, claim, or demand made by any third party due to or arising out of the Users use of any Yale-NUS website in violation of these terms and conditions.

Disputes

  1. Users are solely responsible for their interactions with other Users on a Yale-NUS website. Yale-NUS reserves the right, but has no obligation, to monitor any disputes between Users.

Governing Law and Jurisdiction

  1. These Terms of Use are governed by and construed in accordance with the laws of Singapore and any legal action or proceeding between Yale-NUS and a User for any purpose concerning these Terms of Use shall be brought in a court of competent jurisdiction in Singapore.

Variation of Terms of Use

  1. Yale-NUS may modify these Terms of Use from time to time and such modification shall be effective upon posting on the applicable Yale-NUS website. Users shall be bound by any changes to these Terms of Use when Users continue to access and/or use the applicable Yale-NUS website after any such modification is posted and hence should review these Terms of Use regularly for the latest updated version.

 

C. SPECIFIC TERMS AND CONDITIONS

Yale-NUS Commons Terms and Conditions

By using the Yale-NUS Commons site, or any of its User sites, you accept the Terms of Use and these specific terms and conditions in full. If you disagree with any part of the terms and conditions, you must not use the Yale-NUS Commons or any of its User sites.

Users who are authors or editors of the Yale-NUS Commons (Site Authors) shall abide by applicable laws and policies, including the NUS Acceptable Use of IT Resources, Intellectual Property Policy, and the Yale-NUS Code of Student Conduct. Users shall also abide by the respective handbooks and professional expectations.

Use of the Yale-NUS Commons

Yale-NUS Commons is a platform where the Yale-NUS Community may request a website that may take the form of a blog, portfolio, or informational site. Yale-NUS Commons should only be used for academic, research, or co-curricular purposes. For any other use, please seek permission from Yale-NUS IT by emailing yncit@yale-nus.edu.sg.

Users are responsible for maintaining the security of your account and website, and are fully responsible for all activities that occur under the account and any other actions taken in connection with the website. Users must immediately notify Yale-NUS of any unauthorized uses or any breaches of security.

Users are entirely responsible for the content of, and any harm resulting from, any content posted or made available in connection with your account, such as website links, text, graphics, audio and video files, computer programmes or other materials. By making content available, you represent and warrant that:

  • the downloading, copying and use of the content will not infringe the proprietary rights or intellectual property rights of any third party;
  • you have required consent or permission from the rights holder to post or make available the content;
  • the content does not contain or install any viruses, worms, malware, Trojan horses or other harmful or destructive content;
  • the content is not spam and does not contain unethical content designed to further unlawful acts such as phishing, misleading recipients or spoofing;
  • the content is not pornographic, does not contain threats or incite violence towards individuals or entities, and does not violate the privacy or publicity rights of any third party;
  • your website is not getting advertised via unwanted electronic messages such as spam links on newsgroups, email lists, other blogs and web sites, and similar unsolicited promotional methods;
  • your website is not named in a manner that misleads your readers into thinking that you are another person or company. For example, your websites URL or name is not the name of a person other than yourself or company other than your own; and
  • you will not post any content that may damage the reputation or goodwill of the College;

All materials published in the Yale-NUS Commons shall be non-confidential. No personally identifiable information (or personal data) shall be published.

Site Authors shall be responsible for moderating all comments posted on their site.

Copyright

The College encourages all staff to share their content under an open licence (i.e. Creative Commons), with suitable safeguards and appropriate attribution, after having obtained permission from any third parties or other participants whose intellectual property resides within the content.

Take Down Policy

The College reserves the right to restrict access to or remove any content on the site if the content or material is found to be in violation of the Terms of Use.

Report inappropriate content

If you believe content on any of the user sites is unlawful or in violation of the Yale-NUS Commons Terms and Conditions or Terms of Use, please contact Yale-NUS IT Services by email yncit@yale-nus.edu.sg with the link to the relevant page(s), and a short description of the violation.

Upon receipt of your report, Yale-NUS IT Services will a) acknowledge the receipt of your report and make an initial assessment of its validity; b) Notify the page author to allow them an opportunity to respond; c) Temporarily restrict access to the content that is subject to the report, unless the report is deemed superfluous, or clearly acceptable; and d) consult with the College leadership, or Legal Services, where necessary.

Retention Policy

Site Authors who leave the College will not have access to modify their sites after their last day at Yale-NUS.

Sites administered or authored by Yale-NUS faculty, staff, or students will be retained for a maximum of 60 days after the last administrator or author leaves the College. Any requests for archiving or export of webpages must be submitted before the end of the retention period.

Site administrators may, at any time, request that their sites be restricted or erased by contacting yncit@yale-nus.edu.sg with the link to the relevant site.

Liability

Yale-NUS accepts no liability for any claims, penalties, losses, or expenses arising from the use of, or reliance on any user content; use of or inability to use the site; or unauthorised access or alteration to the site.

Yale-NUS will not be liable for any acts or omissions by You, including any damages of any kind incurred as a result of such acts or omissions.

Changes

Yale-NUS reserves the rights to amend or replace these terms and conditions at any time. If a substantive change is made, we will post a prominent notice on the site. Users agree to the changes by continuing to access to or use the sites.
